Terms of Service

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Tony Augustine Labs (TAL), the operator of eInvite (einvit.in), a digital wedding and celebration invitation platform ("Platform," "Service").

By accessing the eInvite website, creating an account, purchasing a plan, or using any feature of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease using the Platform.

Acceptance and Eligibility

1.1 Age Requirement: You must be at least 18 years of age to create an account, purchase a plan, or use the eInvite Platform. By using the Platform, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not use the Platform without verifiable consent and supervision of a parent or legal guardian.

1.2 Legal Capacity: You represent that you have the legal capacity to enter into a binding contract under Indian law. If you are accessing the Platform on behalf of a business entity (such as an event management company), you represent that you have the authority to bind that entity to these Terms.

1.3 Acceptance of Updates: We may amend these Terms from time to time. The most current version will always be available at einvit.in/terms. Your continued use of the Platform after any amendments constitutes your acceptance of the revised Terms.

Description of Services

eInvite provides a Software-as-a-Service (SaaS) platform enabling individuals and families to:

• Create personalised digital wedding and celebration invitation pages accessible via a unique URL (e.g., einvit.in/w/your-name).
• Collect RSVPs and manage guest lists online.
• Share invitations via WhatsApp, social media, and direct links.
• Display photo galleries, countdown timers, venue maps, and event schedules.
• Access analytics on invitation views and guest responses.
• Choose from community-specific templates for Christian, Hindu, and Muslim occasions including weddings, nikah, walima, first holy communion, vidyarambham, upanayanam, aqiqah, and other Kerala cultural celebrations.

Account Registration and Security

3.1 Registration: To access paid features, you must register for an account by providing a valid email address, name, phone number, and a secure password. You agree to provide accurate, current, and complete information.

3.2 One Account Per Person: Each email address may be associated with only one eInvite account. Creating multiple accounts to circumvent plan limitations or bans is a violation of these Terms.

3.3 Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify us of any suspected unauthorized access to your account at tonyveedon@yahoo.com. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

3.4 Account Accuracy: You agree to keep your account information up to date, particularly your email address, which we use for important service communications.

Subscription Plans and Payments

4.1 Plan Tiers: eInvite offers multiple plan tiers, including a Free plan and several paid plans (Basic, Premium, Premium Plus, Ultimate, and Planner). The features, guest limits, photo limits, validity period, and pricing of each plan are as described on the Pricing page at the time of purchase.

4.2 Pricing: All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to change our pricing at any time. Price changes will not affect any plan you have already purchased for its stated validity period.

4.3 Payment Processing: All payments are processed by Razorpay Payment Solutions Private Limited, a PCI-DSS-compliant payment gateway. eInvite does not store or have access to your payment card numbers, CVV, or net banking credentials. By completing a payment, you also agree to Razorpay's terms and privacy policy.

4.4 Plan Activation: Your paid plan is activated upon successful confirmation of payment from Razorpay. In the event of a payment failure or technical error, your account will not be upgraded until payment is confirmed. Please contact us if you experience any payment issues.

4.5 Plan Validity: Each paid plan grants platform access for a specified number of days from the date of plan activation. After this period, your invitation page may be taken offline. We will endeavour to notify you before your plan expires.

4.6 GST: Payments are subject to Goods and Services Tax (GST) as applicable under Indian law. GST details will be reflected in your payment receipt.

Refund and Cancellation Policy

All purchases on eInvite are subject to our No-Refund Policy, the full terms of which are set out in our Refund Policy. By completing a purchase, you acknowledge and agree that:

• All sales of subscription plans are final and non-refundable.
• No refunds will be issued, whether in full or in part, for any reason including but not limited to change of mind, non-utilisation of features, or event cancellation.
• eInvite's maximum liability to you in any event is strictly limited to the amount actually paid by you for the plan that directly gave rise to the claim.

User Content and Intellectual Property

6.1 Your Content: You retain full ownership of all content you upload or create on the Platform ("User Content"), including names, photos, text, event details, and guest information. You grant eInvite a limited, non-exclusive, royalty-free, worldwide licence to host, store, display, and transmit your User Content solely for the purpose of operating the Platform and providing the Service to you.

6.2 Content Responsibility: You are solely responsible for the accuracy, legality, and appropriateness of all User Content you upload. You represent and warrant that:

• You own or have the necessary rights to all content you upload, including photographs.
• Your content does not infringe any third-party intellectual property, privacy, or personality rights.
• Your content does not contain defamatory, obscene, offensive, or illegal material.

6.3 eInvite Intellectual Property: All software, templates, design elements, code, branding, logos, and platform features of eInvite are the exclusive intellectual property of Tony Augustine Labs (TAL) or its licensors, and are protected by applicable Indian and international copyright and intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

6.4 Template Licence: Upon activating your plan, we grant you a non-exclusive, non-transferable, revocable licence to use the Platform's templates solely for creating your personal event invitation. This licence does not permit resale, redistribution, or commercial reproduction of templates.

Acceptable Use and Prohibited Conduct

You agree to use the Platform only for its intended purpose — creating and sharing personal event invitations — and only in compliance with these Terms and all applicable laws. The following conduct is strictly prohibited:

• Using the Platform to conduct any fraudulent, illegal, or deceptive activity.
• Uploading content that is defamatory, obscene, pornographic, abusive, threatening, or harmful to minors.
• Impersonating any person, organisation, or public figure.
• Attempting to gain unauthorised access to any account, system, or data on the Platform.
• Using automated scripts, bots, scrapers, or crawlers to access the Platform without our written permission.
• Reverse-engineering, decompiling, or disassembling any software or component of the Platform.
• Using the Platform to send unsolicited bulk messages or spam to guest contacts.
• Uploading malware, viruses, or any code designed to disrupt or damage Platform functionality.
• Reselling, sublicensing, or commercially exploiting the Platform or its features without written authorisation.
• Violating any applicable Indian law, including the IT Act 2000, Indian Penal Code, or Consumer Protection Act 2019.

We reserve the right to suspend or permanently terminate any account found to be engaging in prohibited conduct, without prior notice and without liability to you.

Service Availability and Modifications

8.1 Uptime: We strive to maintain high availability of the eInvite Platform; however, we do not guarantee uninterrupted or error-free service. Planned and unplanned maintenance, Cloudflare infrastructure issues, third-party service outages, or force majeure events may cause temporary interruptions.

8.2 Modifications: We reserve the right to modify, update, or discontinue any feature, template, or aspect of the Platform at any time, with or without notice. We will make reasonable efforts to communicate material changes that affect active paid subscribers.

8.3 No Compensation for Downtime: Unless expressly required by applicable law, we will not be obligated to provide refunds, credits, or other compensation for service interruptions, changes to features, or unavailability of the Platform.

Disclaimer of Warranties

The eInvite Platform and all associated services are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranty of any kind, whether express, implied, statutory, or otherwise.

To the fullest extent permitted by applicable Indian law, Tony Augustine Labs expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Any warranty that the Platform will meet your specific requirements or expectations.
• Any warranty that the Platform will be uninterrupted, timely, secure, or error-free.
• Any warranty regarding the accuracy, reliability, or completeness of any information on the Platform.

You use the Platform at your own risk and discretion. Any content or data downloaded or otherwise obtained through the Platform is at your own risk.

Limitation of Liability

To the maximum extent permitted under applicable Indian law, Tony Augustine Labs, its founders, employees, agents, and service providers shall not be liable to you or any third party for:

• Any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, or loss of business opportunity.
• Any damages arising from service interruptions, data loss, unauthorised access, or failure of third-party services (including Razorpay, Cloudflare, or Resend).
• Any claims arising from user-generated content or actions of other users.
• Any outcomes resulting from reliance on information or services provided on the Platform.

In all cases where Tony Augustine Labs is found to be liable to you, regardless of the cause or theory of liability, our total aggregate liability shall not exceed the amount you actually paid to eInvite for the subscription plan directly giving rise to the claim. We shall have no liability beyond this amount under any circumstances.

This limitation applies even if Tony Augustine Labs has been advised of the possibility of such damages and even if any limited remedy fails of its essential purpose.

Indemnification

You agree to indemnify, defend, and hold harmless Tony Augustine Labs, its founders, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of or access to the Platform.
• Your User Content, including any claim that it infringes a third party's intellectual property or privacy rights.
• Your breach of these Terms.
• Your violation of any applicable law, regulation, or third-party rights.
• Any dispute between you and any guest or third party in connection with your use of the Platform.

Termination

12.1 By You: You may stop using the Platform at any time. To request account deletion, contact us at tonyveedon@yahoo.com. Account deletion does not entitle you to any refund of any amount paid.

12.2 By Us: We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or for any other reason we deem necessary to protect the Platform, its users, or our business. Termination by us for cause does not entitle you to any refund.

12.3 Effect of Termination: Upon termination, your right to access the Platform ceases immediately. Your invitation pages will be taken offline. Any User Content associated with your account may be deleted after a reasonable retention period, subject to our data retention obligations under applicable law.

12.4 Survival: Provisions that by their nature should survive termination, including Sections 6 (Intellectual Property), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Governing Law), shall survive termination of these Terms.

Governing Law and Dispute Resolution

13.1 Governing Law: These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law provisions.

13.2 Jurisdiction: The courts of Kerala, India shall have exclusive jurisdiction over any legal proceedings arising from or related to these Terms or the use of the Platform. By using the Platform, you irrevocably submit to the personal jurisdiction of these courts.

13.3 Informal Resolution: Before initiating any formal legal proceedings, you agree to first contact us at tonyveedon@yahoo.com and make a good-faith effort to resolve the dispute informally within 30 days. We are committed to resolving concerns amicably where possible.

13.4 Consumer Rights: Nothing in these Terms is intended to limit or exclude any rights you may have as a consumer under the Consumer Protection Act, 2019 or any other mandatory consumer protection legislation applicable in India.

Miscellaneous

14.1 Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Tony Augustine Labs regarding the use of the Platform and supersede all prior agreements or understandings.

14.2 Severability: If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

14.3 Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

14.4 Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely, including in connection with a merger or acquisition.

14.5 Language: These Terms are written in English. In the event of any translation or interpretation conflict, the English version shall prevail.

14.6 Force Majeure: We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, strikes, pandemics, government actions, internet outages, or third-party platform failures.
